Please take the time to read and understand the terms and conditions set out below prior to booking a photo tour, photo session or a workshop with us.

All photo tours, portrait sessions, workshops, and any other services ( collectively hereinafter referred to as 'services' and 'sessions') advertised on our website are operated by ShootRome Photography & Tours (hereinafter referred to as, SHOOTROME, 'we', 'us' or 'our').

We only employ the services of licensed qualified and reputable professionals for the organization and administration of services.

The payment of a NON-REFUNDABLE RESERVATION FEE for a photo tour/session/workshop implies the full acceptance of the following Terms and Conditions.

PLEASE NOTE THAT THE “ARBITRATION AGREEMENT” SECTION BELOW CONTAINS PROVISIONS THAT REQUIRE (i) ALL DISPUTES ARISING BETWEEN THE PARTICIPANT AND SHOOTROME UNDER THIS AGREEMENT TO BE RESOLVED IN BINDING ARBITRATION, AND NOT IN COURT, AND (ii) THE PARTICIPANT AND SHOOTROME WAIVE THE RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION IN CONNECTION WITH SUCH DISPUTES.

PLEASE BE SURE TO READ AND REVIEW CAREFULLY THE ENTIRE SECTION LABELED “ARBITRATION AGREEMENT” BELOW. BY ACCEPTING THIS AGREEMENT, THE PARTICIPANT AGREES TO BE BOUND BY THE ARBITRATION AGREEMENT.

Liability Release

By registering for a photo tour/portrait session/workshop, or any other services, participants certify that they have carefully read the dates, itinerary, schedule of activities, the requirements and the “Terms & Conditions” for the Photo Tour / Portrait Session / Workshop and are aware that the tours, sessions and workshops, in its adventurous natures, inherently involve the risk of personal injury, death, loss or damage to property.

Further, by registering for the any of the services advertised or not on SHOOTROME.COM, all participants voluntarily recognize, acknowledge and accept all risks thereof. Participants agree on behalf of themselves, their dependents, heirs, executors, and assigns, to release and hold harmless SHOOTROME, its employees, subsidiaries, servants, affiliates, officers, directors, successors, representatives, assigns from any and all claims, including but not limited to liability for delays, cancellations, monetary damages, illness, injuries, death, or for the loss of or damage to property resulting directly or indirectly from ANY occurrences or conditions, caused by willful, negligent or otherwise acts or omissions. Participants agree to abide by the conditions set forth under the “Terms and Conditions” and other sections as stated herein or elsewhere published. Participants affirm that they are covered by travel and medical insurance, which is valid in Italy, and affirm that they have not relied on any additional oral or written representation for executing this release. Participants further acknowledge receipt of this release and understand and accept its terms and conditions. Any questions participants had concerning this release have been answered fully.

We rely upon services provided by suppliers (“Other Providers”) that are independent contractors and are separate entities from us. Other Providers are suppliers of services that include, but are not limited to, transportation, accommodations, meals, and excursions using local guides. Other Providers are solely responsible and liable for providing their respective services.

Furthermore and more specifically, We, our subsidiaries, employees, affiliates, officers, directors, successors, representatives, photo leaders, assigns will not be held liable for
(A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by a willful or negligent act and/or omission of any Other Providers, their employees, agents, servants, or representatives, including, without limitation, their failure or inadequate delivery of services, any defect in any aircraft, watercraft, or vehicle operated or provided by such Other Provider;
(B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond our control.
(C) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by a willful or negligent act and/or omission of SHOOTROME, our subsidiaries, employees, affiliates, officers, directors, successors, representatives, photo leaders, assigns, including, without limitation, their failure or inadequate delivery of services.
The participant waives any claim against the SHOOTROME and/or any of the aboved-mentioned parties associated to SHOOTROME for any such loss, damage, injury, or death.

We are not responsible for expenses incurred by tour/session/workshop members in preparing for the tour/session/workshop (i.e.: air tickets, visa/passport fees, equipment, medical expenses, individual transfers, etc.).

We reserve the right in our sole discretion to accept, decline to accept, or remove any participant on an photo tour, photo session, workshop or any service provided. We reserve the right, without penalty, to make changes in the published itinerary whenever, in our judgement, conditions warrant or if we deem it necessary for the comfort, convenience, or safety of the participants.

Assumption of Risk

Participants are voluntarily participating in the tour, session, and/or workshop with knowledge that it involves some inherent risks and danger including, but not limited to, forces of nature, terrorism, civil unrest, strikes, wild animals (including animals used for transportation), all activities including hiking over rough terrain, theft, cancellation or changes in itinerary, negligent action of others or their agencies, or means of conveyance or accommodation which may not be operated nor maintained to standards common in Western countries. This includes health-related issues, and participants are aware that medical services or facilities may not be readily available or accessible during all or part of the photo tour, photo session, workshop. This includes emergency medical care, presence of physicians, and adequate medication. By registering for a photo tour/session/workshop, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for himself or herself or other participants. It is the participant's responsibility to judge the appropriateness of the photo tour/workshop and the planned activities to their own physical and mental capabilities. We and our suppliers take no responsibility for special arrangements or problems incurred by participants unable to participate in the tour, session, workshop or planned activities. Participants understand that group leaders may not possess the required training or equipment to handle incidents that may occur. In case of injury, accident, illness, or inability to complete the tour/session/workshop, the participant will bear the full cost of any additional transportation or evacuation procedures necessary. The right is reserved to decline any person as a member of the tour/session/workshop, or to require any participant to withdraw from the tour/session/workshop at any time.

Age & Health Requirements

For all of our photo tours the minimum age is 18 at the time of travel and although there is no upper age limit, by registering for a tour/session/workshop, all participants must ensure that they are suitably fit to allow full participation in the tour/session/workshop and planned activities, and that they do not have any mental, physical, or other condition or disability that would create a hazard for himself or herself or other participants. Minors must be accompanied by at least one parent or legal guardian. Any physical condition, diet, or treatment requiring special attention must be reported in writing when the reservation is made. We encourage participants to consult a doctor for specific medical advice about any activities or destinations. Certain photo/sessions/workshop may require that the participant obtain medical consent prior to departure as a condition of participation.

Code of Conduct

Participants are expected to conduct themselves in a manner that is respectful to the group and other participants. You are also expected to behave responsibly and respectfully towards local customs. Any use of illegal drugs or substances, committing or participating in any criminal or illegal activity and violence of any sort will not be tolerated and will result in the participant's immediate removal from the Tour, without refund and at the participant's expense. Group leaders are authorized, and hereby reserve the right, to remove or exclude participants from the tour/session/workshop, or any portion thereof, for actions they deem as inappropriate or disruptive to the group or tour/session/workshop.

Indemnification

The participant, their agency, or who is acting on their behalf and its affiliate companies, agrees to defend and indemnify us from and against any and all demands, claims or lawsuits (including without limitation, third party asserted demands, claims or lawsuits), actions, liabilities, damages, costs, losses and/or expenses (including reasonable attorneys' fees and expenses) (collectively, “Claims and Damages”) which we may incur, suffer or be required to pay by reason of actions taken by the Participant, including those which result in damage to property owned by third parties, or any other Claims and Damages arising in connection with a third party claim suffered due to actions taken by the Participant. The Participant is liable to reimburse us for any Claims and Damages collected by third parties, during the provision of services or after, as a result of or related to actions taken by the Participant.

Airfare

Airfare is NOT included in the tour/session/workshop rates provided. We can accept no responsibility for losses or additional expenses on airfare due to tour cancellation or alteration. We advise participants to book a refundable fare or purchase the optional insurance in case the tour/session/workshop is cancelled, postponed or altered.

Inclusions

Pre-departure information; tickets, entrance fees, excursions, and sightseeing noted as included on the photo tour/session/workshop information page; group ground transportation during the photo tour; services of local guides, drivers, lecturers, photo tour leaders, and any other staff.

Exclusions

Domestic or International airfare to the departure and arrival locations; airport transfers, taxes and excess baggage charges; additional transfers or accommodations that may be required by those not traveling with the group; activities noted as optional in the information page; passport, visa, and permit expenses; individual medical expenses and immunizations; photographic equipment; any activities listed as optional on the tour/session/workshop website page; any activity taken on your own; baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, and alcoholic beverages; possible fuel surcharges where applicable; exchange rate surcharges; gratuities to the guides and drivers are customary, and any other items not specifically noted as included on the photo tour/session/workshop information page or noted as optional.

Registrations, Payments, Postponements, Cancellations, and Refunds

All prices and fares are quoted in Euros. The rates are based on tariffs, currency values and third-party charges as of catalog publication date and are subject to change due to unforeseen circumstances. While SHOOTROME will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge, SHOOTROME reserves the right to do so, and notification will be given at the time of final invoicing.

When making this booking, you warrant that you have the authority to enter into this contract on behalf of all other members of your party and that you are responsible for ensuring due payment of all monies payable in respect of this booking, in the event of default by any member of the party. Whether you book alone or as a group, we will only deal with the lead name in all subsequent correspondence, including changes, amendments and cancellations. The lead name is responsible for ensuring the accuracy of the personal details or any other information supplied in respect of yourself and any other person travelling on the booking and for passing on any information regarding the booking or any changes made in relation thereto, to all persons travelling on such booking, including but not limited to information on schedule changes or copies of booking confirmations.

If we accept your registration, we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or when we accept your payment.

A NON-REFUNDABLE RESERVATION FEE may be required at time of registration to secure space, with the NON-REFUNDABLE RESERVATION FEE amount specified on the photo tour/session/workshop website page. Alternatively it may be communicated via email. Full payment is required before the event date to complete the registration. If full payment is not received when due, your space will be subject to cancellation.

To protect your investment, we recommend that you purchase a travel insurance.

All postpoment and cancellation notices must be sent via email. Please note your cancellation is not considered effective until you have received a return email confirmation acknowledging your cancellation.

For any of our services of eight hours (8) or less, Per-person postponement or cancellation charges are as follows
Forty-eight hours (48) or more prior to the contracted date/time: the NON-REFUNDABLE RESERVATION FEE can be used as credit to book another service within the next 12 months from the scheduled date. Any additional costs incurred, as well as any fees that are charged by the suppliers providing the services included in the service will be forfeited. The reminder of the payment will be refunded minus payment processing fees.
Less than forty-eight hours (48) prior to the contracted date/time: NO REFUNDS WILL BE GRANTED. The entire amount already paid will be forfeited.

For any of our services of 1 day or more, Per-person cancellation charges are as follows
Fifteen days (15) or more prior to the contracted date: the NON-REFUNDABLE RESERVATION FEE will be forfeited, as per definition, along with any additional costs incurred, as well as any fees that are charged by the suppliers providing the services included in the service. The reminder of the payment will be refunded minus payment processing fees.
Forteen days (14) or less prior to the contracted date or anytime after the contracted date: NO REFUNDS WILL BE GRANTED and the full payment will be forfeited. Payments in full are required no later than 15 days prior to the contracted date. If full and final payment is not received by this date you will be notified via email two times requesting final payment. After that, we will consider your failure to make payment a cancellation and your spot in the photo tour/session/workshop will be forfeited and offered to those participants on the waiting list. Provision of services that require the employment of third parties require the full amount upfront and it is to be considered non-refundable.

Inclement Weather

For any of our services of eight hours (8) or less only, The Client may request a postponement, in writing, via email only, due to inclement weather with 50% chance or above of light rain or drizzle. The request for postponement for inclement weather must come at least twenty-four hours (24) prior to the scheduled session, and must be approved by the Photographer. Every effort will be made to reschedule the session contingently on our availability or to proceed as per contract and move to a different location (indoors or with cover). Unless postponed, all services/sessions are rain or shine. However, as electronic equipment is not designed to operate under the rain or snow, we will not guarantee the photographic session will proceed as planned. It may in your best interest to consider rescheduling or a location indoors or with cover.

Photography on Photo Tours and Workshops

SHOOTROME and the group leaders reserve the right to take photographs or videos during the operation of any Tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation with ShootRome Photography & Tours, whether it be a photo tour, a workshop, a photo session or any of the services provided, the participant agrees to allow his/her likeness to be used by SHOOTROME without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify SHOOTROME in writing prior to commencement of the photo tour/session/workshop. A participant may wish to provide material voluntarily to SHOOTROME. Copyright in all photographs, video, and related materials created by the participant (“Photo Tour Materials”) will belong to the participant upon creation. The participant grants to SHOOTROME a non-exclusive, worldwide, irrevocable license to use any photo tour/session/workshop materials voluntarily provided to SHOOTROME in any media for the following limited purposes: editorial use, promotion of this editorial use, promotion of SHOOTROME's event programs, or promotion of the mission of the SHOOTROME.

Passport and Visas

All participants must carry a valid passport or a valid form of ID at all times and the appropriate visa.

Flexibility

Participants appreciate and acknowledge that the nature of our photo tours/sessions/workshops may require some flexibility and you should allow for alternatives.

Arbitration Agreement

The parties agree that they will attempt in good faith to settle any and all disputes, controversies or claims arising out of the present contract to a mediation attempt managed by the Service of Mediation of the Chamber of Arbitration of Rome, Arbitra Camera, Italy

If the mediation attempt fails, the dispute, controversy or claim arising under, out of or relating to this contract and any subsequent amendments of this contract, including, without limitation, its formation, validity, binding effect, interpretation, performance, breach or termination, shall be settled by arbitration under the Rules of the Chamber of Arbitration of Rome (the Rules), Arbitra Camera, by a sole arbitrator. The place of mediation shall be Rome, Italy. The language to be used in the mediation shall be Italian.

The parties further agree that the maximum amount of recovery to which a participant will be entitled under any and all circumstances will be the published cost of the participant's tour/session/workshop with SHOOTROME. This agreement to arbitrate does not waive or modify any liability release agreed by the participant.

Authority on the photo tour/session/workshop

Our photo tours are run by one or two group leaders. The decision of a group leader is final on all matters likely to affect the safety or well-being of any participant in the tour/session/workshop. If a participant fails to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct that participant to leave the tour/session/workshop immediately, with no right of refund. We may also elect not to honor your registration on any future photo tour/session/workshop booked. Participants must at all times comply with the laws, customs, foreign exchange and drug regulations of Italy, and must also agree to travel in accordance with our responsible travel guidelines.

Privacy Policy

Any personal information that we collect about participants may be used for any purpose associated with the operation of a photo tour/session/workshop or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers with the purpose of administering services we are providing to you such as arranging your tour booking. The information may also be disclosed to provide relevant information, which may include sensitive personal information, to insurers, their agents and medical staff in circumstances where we/they need to act on your behalf or in the interest of participants or in an emergency.

This website uses cookies to better the users experience while visiting the website. As required by legislation, where applicable this website uses a cookie control system, allowing the user to give explicit permission or to deny the use of /saving of cookies on their computer / device.

By registering for a tour/session/workshop with SHOOTROME, the participant agrees to the liability release statement and the Terms and Conditions published on the website www.SHOOTROME.com.

Participants hereby acknowledge that they have read, understand and agree to, and will abide by, all the Terms and Conditions of participation in the photo tour/session/workshop as set out above.

Final Payment in FULL is required before the commencement of tour/session/workshop or participants risk losing the NON-REFUNDABLE RESERVATION FEE, if any, and having their spot forfeited to a participant on the waiting list.

Participants will be sent an invoice via email requesting final payment. You can email us if you have any questions regarding making final payment. Alternatively a paper invoice may be provided at the time of the photo tour/session/workshop.
